{"id":24600,"date":"2026-08-13T09:14:27","date_gmt":"2026-08-13T09:14:27","guid":{"rendered":"https:\/\/fiskl.com\/?post_type=legal&#038;p=24600"},"modified":"2026-08-13T09:20:07","modified_gmt":"2026-08-13T09:20:07","slug":"payment-authorization-terms","status":"publish","type":"legal","link":"https:\/\/fiskl.com\/legal\/payment-authorization-terms\/","title":{"rendered":"Payment Authorization Terms"},"content":{"rendered":"<p>These Payment Authorization Terms apply when you authorize a business to charge your payment card for invoices it issues to you, where that business collects payment through the Fiskl Platforms.<\/p>\n<p>Read them before you authorize a card to be charged. A copy will be emailed to you when you give your authorization.<\/p>\n<h2>1. Who these terms are between<\/h2>\n<p>1.1 <strong>You<\/strong>, or the <strong>Payer<\/strong>, are the person or business paying an invoice.<\/p>\n<p>1.2 The <strong>Merchant<\/strong> is the business that issued the invoice to you and that you are authorizing to charge your card. The Merchant\u2019s legal name and location are shown on the payment page and repeated in the confirmation email described in section 5.1.<\/p>\n<p>1.3 <strong>Fiskl<\/strong> is Fiskl Limited, a company incorporated in England and Wales with company number 09330290. Fiskl provides the software the Merchant uses to issue invoices, send notices, and collect payment. Fiskl is not the seller, is not a party to your agreement with the Merchant, and is not responsible for the goods or services the Merchant invoices you for.<\/p>\n<p>1.4 The <strong>Authorization<\/strong> described in these terms runs between you and the Merchant. Fiskl acts on the Merchant\u2019s instructions.<\/p>\n<p>1.5 The <strong>Card<\/strong> is the payment card you authorize the Merchant to charge. Its brand and last four digits are confirmed in the email described in section 5.1.<\/p>\n<h2>2. What you authorize<\/h2>\n<p>2.1 By checking the authorization box on the payment page and completing your payment, you authorize the Merchant to send instructions to the bank that issued your Card to take payments from your card account.<\/p>\n<p>2.2 The Merchant may charge the Card without contacting you at the time of each charge. Section 5.2 sets out the notice the Merchant sends you before every charge.<\/p>\n<p>2.3 The Merchant may use the Card only to collect amounts you owe it under invoices it issues to you. It may not use the Card for any other purpose.<\/p>\n<p>2.4 You confirm that you are the cardholder, or that the cardholder has authorized you to give this Authorization.<\/p>\n<h2>3. When the Card will be charged<\/h2>\n<p>3.1 The Merchant may charge the Card on the due date of each invoice it issues to you, or on any later date while that invoice remains unpaid.<\/p>\n<p>3.2 Where you and the Merchant have agreed on a fixed billing schedule, the Merchant may charge the Card on the dates in that schedule. Those dates are shown on the payment page and in the confirmation email.<\/p>\n<p>3.3 The Merchant will not charge the Card unless it has sent you the notice required by section 5.2.<\/p>\n<p>3.4 If a charge fails, the Merchant may try the Card again. If it still fails, the Merchant will stop trying and will contact you.<\/p>\n<h2>4. How the amount is determined<\/h2>\n<p>4.1 Each charge is the amount shown as due on the invoice the Merchant issues to you, in the currency of that invoice. It includes any tax shown on the invoice and any late payment fee applied under your agreement with the Merchant.<\/p>\n<p>4.2 Invoice amounts vary, so the amount charged will not always be the same. It will be the same each time only where your agreement with the Merchant provides for fixed amounts.<\/p>\n<p>4.3 Where a maximum has been set, no single charge will exceed that maximum without the Merchant asking you to approve it first. Any maximum is shown on the payment page and in the confirmation email.<\/p>\n<p>4.4 Where the Merchant charges a card fee, that fee is shown on the payment page and is included in the amount charged.<\/p>\n<h2>5. Confirmation, notices, and receipts<\/h2>\n<p>5.1 <strong>Confirmation when you authorize.<\/strong> The Merchant will email you immediately after you give your Authorization. That email confirms the brand and last four digits of the Card, the Merchant\u2019s legal name and city, how the amount of each charge is determined, when charges will be taken, any maximum that applies, and a link to cancel. Keep it for your records.<\/p>\n<p>5.2 <strong>Notice before each charge.<\/strong> The Merchant will email you at least ten days before each charge. That notice states the exact amount, the date of the charge, the last four digits of the Card, the invoice it relates to, and a link to cancel.<\/p>\n<p>5.3 <strong>Receipt after each charge.<\/strong> The Merchant will email you a receipt after each charge. The receipt includes a link to cancel future charges.<\/p>\n<p>5.4 <strong>Where notices are sent.<\/strong> The Merchant sends these emails to the address you gave on the payment page. Tell the Merchant if that address changes. The Merchant is not responsible for notices you do not receive because the address you gave is out of date, or because the emails are filtered by your email provider.<\/p>\n<p>5.5 <strong>Who sends them.<\/strong> These emails come from the Merchant. Fiskl sends them on the Merchant\u2019s instructions, using the Merchant\u2019s name and contact details.<\/p>\n<h2>6. Canceling your Authorization<\/h2>\n<p>6.1 You may cancel your Authorization at any time. There is no fee for canceling.<\/p>\n<p>6.2 To cancel, use the cancellation link in any email described in section 5, or contact the Merchant using the details in that email.<\/p>\n<p>6.3 Cancellation takes effect immediately for any charge that has not already been sent to your bank. A charge already in progress may still complete.<\/p>\n<p>6.4 The Merchant will email you to confirm that your Authorization has been canceled and that no further automatic charges will be taken.<\/p>\n<p>6.5 Canceling your Authorization stops future automatic charges. It does not cancel any invoice you already owe, does not end your agreement with the Merchant, and does not by itself entitle you to a refund. You remain responsible for paying invoices by another method.<\/p>\n<p>6.6 You may also instruct your bank to stop payments on the Card. If you do, the Merchant may only learn of this when a charge is declined.<\/p>\n<h2>7. How long your Authorization lasts<\/h2>\n<p>7.1 Your Authorization continues until you cancel it under section 6, the Merchant stops using it, or the Card expires and is not replaced.<\/p>\n<p>7.2 Where you and the Merchant have agreed on an end date, that date is shown on the payment page and in the confirmation email, and the Authorization ends then.<\/p>\n<p>7.3 If your bank replaces the Card with a card of a different brand, your Authorization ends. The Merchant will ask you to give a new one before charging that card.<\/p>\n<h2>8. Changes to these terms<\/h2>\n<p>8.1 The Merchant will email you at least ten days before any change to these terms, to when charges are taken, or to how the amount of a charge is determined.<\/p>\n<p>8.2 You may cancel your Authorization at any time before the change takes effect. If you do not cancel, the change applies to charges taken after it takes effect.<\/p>\n<p>8.3 Fiskl may update these terms where required by law, by card network rules, or by a change to the Fiskl Platforms. The Merchant will notify you under section 8.1.<\/p>\n<h2>9. Refunds, errors, and disputes<\/h2>\n<p>9.1 If you think a charge is wrong, contact the Merchant first, using the details in any email described in section 5. The Merchant is responsible for the invoice, the amount, and any refund.<\/p>\n<p>9.2 Refunds are governed by your agreement with the Merchant. Ask the Merchant for its refund policy.<\/p>\n<p>9.3 Nothing in these terms affects your statutory rights, or your right to dispute a charge with the bank that issued your Card.<\/p>\n<h2>10. Your card details<\/h2>\n<p>10.1 Your card details are captured and stored by Stripe, a payment provider certified to PCI DSS Level 1.<\/p>\n<p>10.2 Neither the Merchant nor Fiskl receives or holds your full card number.<\/p>\n<p>10.3 Fiskl holds a secure reference to your Card supplied by Stripe, together with the card brand, the last four digits, and the expiration date. This lets the Merchant charge the Card and lets you identify it.<\/p>\n<p>10.4 Fiskl keeps a record of your Authorization, including the terms you agreed to, the date and time, and the internet address the Authorization was given from. Card network rules require this record to be kept and produced to your bank on request.<\/p>\n<h2>11. Personal data<\/h2>\n<p>11.1 The Merchant decides how your personal data is used in connection with its invoices and this Authorization. Fiskl processes that data on the Merchant\u2019s instructions.<\/p>\n<p>11.2 Fiskl\u2019s Privacy Policy at fiskl.com\/legal\/privacy-policy explains how Fiskl handles personal data. For how the Merchant handles your data, contact the Merchant.<\/p>\n<h2>12. Fiskl\u2019s role and liability<\/h2>\n<p>12.1 Fiskl provides software. Fiskl is not the seller, is not a party to your agreement with the Merchant, and does not receive, hold, or control your funds. Payments are processed by Stripe and settle to the Merchant.<\/p>\n<p>12.2 Fiskl is not responsible for the goods or services the Merchant invoices you for, for the amount of any invoice, or for the Merchant\u2019s refund decisions.<\/p>\n<p>12.3 Fiskl\u2019s total liability to you in connection with these terms is limited to USD 100.<\/p>\n<p>12.4 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited by law.<\/p>\n<h2>13. Governing law<\/h2>\n<p>13.1 These terms are governed by the laws of England and Wales.<\/p>\n<p>13.2 The courts of England and Wales have exclusive jurisdiction over any dispute arising from these terms.<\/p>\n<p>13.3 If you are a consumer, you may also bring proceedings in the courts of the country where you live, and you keep the benefit of any consumer protection that cannot be waived under the law of that country.<\/p>\n<h2>14.
